The online store "Mebelstar.com.ua", located on the domain Mebelstar.com.ua, trading organization Sole Proprietor Ternavska Yuliia Hryhorivna, Tax ID (TIN) 2958809347, registered address of the individual entrepreneur: Ukraine, 09107, Kyiv region, Bila Tserkva district, Bila Tserkva city, 13 Kalnyshevskoho Petra Street, apartment 65, hereinafter referred to as the "Seller", publishes this Public Offer for the sale of Goods by distance.

1. Definition of Terms

  • 1.1. Public Offer (hereinafter – "Offer"): a public proposal by the Seller addressed to the general public to conclude a distance purchase and sale agreement (hereinafter - the "Agreement") with the Seller under the conditions contained in the Offer, including all annexes.
  • 1.2. Order of Goods on the Online Store website (hereinafter - "Order"): items specified by the Buyer from the range of Goods offered for sale when filling out an application for the purchase of Goods on the Online Store website or through the Operator.

2. General Provisions

  • 2.1. Ordering Goods placed on the Online Store website by the Buyer means that the Buyer agrees to all the terms of this Offer, in accordance with Art. 633 of the Civil Code of Ukraine.
  • 2.2. The administration of the Online Store website has the right to make changes to the Offer without prior notice to the Buyer.
  • 2.3. The duration of the Offer is unlimited unless otherwise indicated on the Online Store website.
  • 2.4. The Seller provides the Buyer with complete and reliable information about the Goods, including information on main consumer properties, place of manufacture, as well as information on the warranty period and shelf life on the Online Store website.

3. Price of Goods

  • 3.1. The price for each item of goods is indicated on the Online Store website.
  • 3.2. The Seller has the right to unilaterally change the price for any item of goods or delivery.
  • 3.3. In case of a price change for the ordered Goods or Delivery, the Seller undertakes to inform the Buyer of the change within ten days.
  • 3.4. The Buyer has the right to confirm or cancel the Order for the purchase of Goods if the price is changed by the Seller after the Order has been placed.
  • 3.5. Changing the price for Goods already paid for by the Buyer is not allowed.
  • 3.6. The Seller indicates the cost of delivery on the Online Store website or informs the Buyer during order placement by the Operator.
  • 3.7. The Buyer's obligations to pay for the Goods are considered fulfilled from the moment the funds are received by the Seller.
  • 3.8. Settlements between the Seller and the Buyer for the Goods are carried out by the methods indicated on the Online Store website.

4. Ordering Process

  • 4.1. Ordering Goods is carried out by the Buyer through the Operator via the phone number indicated on the website or through the Online Store website service at https://mebelstar.com.ua.
  • 4.2. When registering on the website, the Buyer undertakes to provide the necessary registration information.
  • 4.3. The name, quantity, assortment, article number, and price of the Goods selected by the Buyer are indicated in the Buyer's shopping cart on the website.
  • 4.4. If the Seller requires additional information to fulfill the Order, they may request it from the Buyer.
  • 4.5. Acceptance of the terms of this Offer by the Buyer is carried out by entering the relevant data into the registration form or during the Order placement through the Operator.

5. Delivery and Transfer of Goods to the Buyer

  • 5.1. The Seller provides the Buyer with services for the delivery of Goods by one of the methods indicated on the website.
  • 5.2. If the Agreement is concluded with a condition for the delivery of Goods, the Seller is obliged to deliver the Goods to the place specified by the Buyer within the established timeframe.
  • 5.3. The place of delivery is specified by the Buyer during the Order placement.
  • 5.4. The delivery period consists of the order processing time and the transport time.

6. Acceptance of Goods and Consequences of Refusal

  • 6.1. The Buyer is obliged to accept the goods transferred by the Seller in accordance with Art. 689 of the Civil Code of Ukraine.
  • 6.2. The Buyer is obliged to perform all actions necessary on their part to ensure the transfer and receipt of goods in accordance with Part 2 of Art. 689 of the CCU.
  • 6.3. In case of groundless refusal of the Buyer to accept the goods, the Seller has the right to demand payment for the goods or to withdraw from the Agreement in accordance with Part 4 of Art. 690 of the CCU.
  • 6.4. If the Buyer refused to accept the goods, they are obliged to ensure the safety of such goods in accordance with Part 1 of Art. 690 of the CCU.
  • 6.5. Expenses related to the storage or return of goods are reimbursed in the manner determined by Part 3 of Art. 690 of the CCU.
  • 6.6. The parties may agree on a period during which the Buyer is obliged to accept the goods in accordance with Part 1 of Art. 701 of the CCU.
  • 6.7. If the Buyer failed to appear to accept the goods within the established period, it is considered that the Buyer has withdrawn from the Agreement in accordance with Part 2 of Art. 701 of the CCU.
  • 6.8. Additional costs of the Seller for storage or re-delivery are subject to payment by the Buyer separately in accordance with Part 3 of Art. 701 of the CCU.
  • 6.9. In case of groundless refusal to receive the Goods or non-receipt of the Goods by the Buyer within the established timeframe, the Seller's actual costs for delivery (both ways), as well as storage costs, shall be compensated from the prepayment made by the Buyer. The remaining balance of the prepayment is returned to the Buyer after full reimbursement of the specified costs.

7. Consumer Rights in Distance Selling

  • 7.1. The purchase and sale agreement is concluded at a distance in accordance with Art. 13 of the Law of Ukraine "On Protection of Consumer Rights".
  • 7.2. The Seller provides the Buyer with all mandatory information regarding the characteristics of the goods, price, and terms of termination of the Agreement.
  • 7.4. The Buyer has the right to terminate the Agreement within 14 days from the moment of receipt of the goods.
  • 7.5. The Buyer does not have the right to terminate the Agreement regarding goods manufactured to individual order (Part 5 of Art. 13 of the Law).

8. Refunds

Funds for the goods are returned to the card/account from which the payment was made within 2-3 business days after checking the condition of the goods.

  • 8.1. Refunds are made only after checking the condition of the goods.
  • 8.4. Bank commissions for the transfer are not compensated by the seller.
  • 8.5. In case of groundless refusal to receive the goods, the refund amount is calculated in accordance with the value of the goods minus delivery and storage costs (pursuant to clause 6.9).
  • 8.6. In case of return due to manufacturing defects, the Seller compensates for the delivery costs.
